Acceptance of Terms

By downloading, installing, or using the Pinchanted application ("App") or website ("Service"), you agree to be bound by these Terms and Conditions ("Terms"). If you do not agree to these Terms, please do not use the Service.

We reserve the right to update these Terms at any time. Continued use of the Service after changes constitutes your acceptance of the updated Terms.

The Service

Pinchanted is a mobile application that allows users to catalog their enamel pin collections, identify pins using AI, trade with other collectors, and access a reference database of pins.

We reserve the right to modify, suspend, or discontinue the Service at any time with or without notice.

Accounts

To use Pinchanted, you must create an account. You are responsible for:

• Maintaining the confidentiality of your login credentials
• All activity that occurs under your account
• Providing accurate and up-to-date account information
• Notifying us immediately of any unauthorized use of your account

We reserve the right to suspend or terminate accounts that violate these Terms or engage in fraudulent, abusive, or harmful behaviour.

Subscriptions & Billing

Pinchanted is free to use. We also offer an optional paid subscription for users who wish to support the app's ongoing development. Subscriptions are available on a monthly or annual basis and are processed through the Apple App Store (iOS) or Google Play Store (Android).

• Subscriptions automatically renew unless cancelled at least 24 hours before the renewal date
• Pricing is displayed in the app at the time of purchase and may vary by region
• A free trial, where offered, is shown at the time of purchase; you will not be charged until the trial ends
• Refunds are governed by Apple App Store and Google Play Store policies respectively
• You may cancel your subscription at any time through your device's subscription settings
• After cancellation, any subscription benefits continue until the end of the current billing period

Subscription management is handled through RevenueCat. We do not have access to your payment card information.

AI Features

Pinchanted uses AI technology to help identify pins from photographs. By using the AI identification feature, you acknowledge that:

• Images you submit are sent to a third-party AI provider for processing
• AI identification results are estimates only and may not be fully accurate
• We are not liable for incorrect identifications or valuations
• You should not submit images containing personal or sensitive information

User Content

You retain ownership of any content you submit to Pinchanted, including pin images, collection data, and trade information ("User Content"). By submitting User Content, you grant us a limited, non-exclusive, royalty-free licence to use, store, and display that content solely for the purpose of operating the Service.

You are responsible for ensuring that any content you submit does not violate the rights of any third party, including intellectual property rights.

Prohibited Use

You agree not to:

• Use the Service for any unlawful purpose or in violation of any applicable laws
• Attempt to gain unauthorized access to any part of the Service or its systems
• Reverse engineer, decompile, or disassemble any part of the App
• Use automated tools (bots, scrapers) to access or collect data from the Service
• Harass, abuse, or harm other users through the trading or messaging features
• Submit fraudulent trade offers or misrepresent the condition of pins
• Impersonate any person or entity, or misrepresent your identity
• Interfere with or disrupt the integrity or performance of the Service

Limitation of Liability

To the maximum extent permitted by applicable law, Pinchanted and its operators shall not be liable for:

• Loss or corruption of data, including pin collection data
• Incorrect pin identifications or valuations provided by AI features
• Disputes, losses, or damages arising from trades between users
• Interruption, suspension, or discontinuation of the Service
• Any indirect, incidental, special, or consequential damages

The Service is provided "as is" without warranties of any kind, express or implied.

Governing Law

These Terms are governed by and construed in accordance with the laws of the Province of Ontario, Canada, without regard to its conflict of law provisions.

Any disputes arising from these Terms or your use of the Service shall be subject to the exclusive jurisdiction of the courts of Ontario, Canada.
